Terms and Conditions

Please read these Terms and Conditions carefully before accessing or using any of BIMSRV Academy’s online courses, video lessons, live classes, or related services (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms and Conditions. If you do not agree to all of these terms, then you may not access or use the Services.  

1. Acceptance of Terms:

These Terms and Conditions constitute a legally binding agreement between you (“Student,” “User,” or “you”) and BIMSRV Academy (“BIMSRV,” “we,” “us,” or “our”). By registering for, accessing, or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, our Privacy Policy, and any other guidelines or rules posted on our website or provided to you.  

2. User Accounts:

• To access certain features of the Services, you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials (username and password) and for all activities that occur under your account.  
• You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
• You must be of legal age in your jurisdiction to enter into this agreement or have the consent of a parent or legal guardian.  
• You are solely responsible for any unauthorized use of your account. You agree to notify BIMSRV Academy immediately of any unauthorized access to or use of your account.
• BIMSRV Academy reserves the right to suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to a violation of these Terms and Conditions.  

3. Enrollment and Payment:

• Enrollment in our online courses is subject to availability and our acceptance of your registration.
• You agree to pay the fees specified for the courses you enroll in. All fees are stated in the currency indicated at the time of purchase.
• Payment methods accepted will be as displayed on our website or communicated during the enrollment process.
• By providing your payment information, you represent and warrant that you are authorized to use the designated payment method and that you authorize us (or our third-party payment processor) to charge the applicable fees to your payment method.  
• All payments are non-refundable except as expressly stated in our Cancellation Policy.
• We reserve the right to change our course fees at any time, but such changes will not affect fees for courses you have already enrolled in.

4. Course Access and Content:

• Upon successful enrollment and payment, you will be granted access to the online video lessons and other course materials for the duration specified for the course.
• Access to live online classes via Zoom or Google Meet will be provided according to the schedule published for the course.
• All course content, including but not limited to videos, text, graphics, images, audio, and software, is the intellectual property of BIMSRV Academy or its licensors and is protected by copyright and other intellectual property laws.
• You are granted a limited, non-exclusive, non-transferable license to access and use the course content for your personal, educational purposes only. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the course content without the prior written consent of BIMSRV Academy.  
• You agree not to share your login credentials or course access with any other individuals.

5. Live Online Classes:

• Participation in live online classes conducted via Zoom or Google Meet requires you to have the necessary hardware, software, and internet connectivity. BIMSRV Academy is not responsible for any technical issues you may experience.
• You are expected to conduct yourself respectfully and professionally during live online classes. Disruptive behavior may result in removal from the session.
• Live class sessions may be recorded for the benefit of enrolled students who could not attend live. By participating in live classes, you consent to being recorded. Recordings will be subject to the same intellectual property restrictions as other course content.

6. Global Access:

• Our courses are offered globally. You are responsible for ensuring that your access and use of the Services comply with all applicable laws and regulations in your jurisdiction.
• BIMSRV Academy makes no representations or warranties that the Services or their content are appropriate or available for use in all locations.

7. User Conduct:

• You agree to use the Services only for lawful purposes and in a manner that does not infringe the rights of, restrict, or inhibit anyone else’s use and enjoyment of the Services.  
• You agree not to:
  • Upload, post, email, transmit, or otherwise make available any content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another’s privacy, hateful, or racially, ethnically, or otherwise objectionable.  
  • Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
  • Forge headers or otherwise manipulate identifiers in order to disguise the origin of any content transmitted through the Services.  
  • Upload, post, email, transmit, or otherwise make available any unsolicited or unauthorized advertising, promotional materials, “junk mail,” “spam,” “chain letters,” “pyramid schemes,” or any other form of solicitation.  
  • Upload, post, email, transmit, or otherwise make available any material that contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment.  
  • Interfere with or disrupt the Services or servers or networks connected to the Services, or disobey any requirements, procedures, policies, or regulations of networks connected to the Services.  
  • Attempt to gain unauthorized access to any portion or feature of the Services, or any other systems or networks connected to the Services or to any BIMSRV Academy server, or to any of the services offered on or through the Services, by hacking, password “mining,” or any other illegitimate means.  

8. Disclaimer of Warranties:

• The Services and all content included therein are provided on an “as is” and “as available” basis without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.  
• BIMSRV Academy does not warrant that the Services will be uninterrupted or error-free, that defects will be corrected, or that the Services or the servers that make the Services available are free of viruses or other harmful components.  
• BIMSRV Academy makes no warranties or representations about the accuracy, completeness, reliability, or timeliness of the content provided through the Services.
• Any reliance you place on such information is strictly at your own risk.

9. Limitation of Liability:

• To the fullest extent permitted by applicable law, BIMSRV Academy shall not be liable for any indirect, incidental, special, consequential, or punitive damages (including, without limitation, damages for loss of profits, data, use, goodwill, or other intangible losses) arising out of or relating to your access to or use of, or your inability to access or use, the Services, whether based on warranty, contract, tort (including negligence), statute, or any other legal theory, even if BIMSRV Academy has been advised of the possibility of such damages.  
• In no event shall BIMSRV Academy’s total liability to you for all claims arising out of or relating to the Services exceed the total amount paid by you to BIMSRV Academy for the specific course or service in question.

10. Indemnification:

You agree to indemnify, defend, and hold harmless BIMSRV Academy, its affiliates, officers, directors, employees, agents, licensors, and suppliers from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your breach of these Terms and Conditions, your use of the Services, or your violation of any law or the rights of a third party.  

11. Intellectual Property:

• All intellectual property rights in and to the Services and the course content (excluding User Content, as defined below) are owned by BIMSRV Academy or its licensors.
• You acknowledge that you have no right, title, or interest in or to the Services or the course content, except for the limited license granted to you under these Terms and Conditions.
• Any feedback, suggestions, ideas, or other information you provide to BIMSRV Academy regarding the Services (“Feedback”) will be the exclusive property of BIMSRV Academy. You hereby assign to BIMSRV Academy all rights, title, and interest in and to such Feedback without any right to compensation.

12. User Content:

• You may be permitted to submit, upload, post, or otherwise make available content, such as comments or questions in forums or during live classes (“User Content”).
• You retain all rights in, and are solely responsible for, the User Content you make available through the Services.
• By making any User Content available through the Services, you hereby grant to BIMSRV Academy a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use, copy, modify, create derivative works based upon, distribute, publicly display, and publicly perform your User Content in connection with the Services.  
• You represent and warrant that your User Content does not violate these Terms and Conditions, any applicable laws, or the intellectual property or other rights of any third party.
• BIMSRV Academy reserves the right to remove or disable access to any User Content at any time and for any reason, without notice.

13. Third-Party Links and Services:

The Services may contain links to third-party websites or services that are not owned or controlled by BIMSRV Academy. BIMSRV Academy has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that BIMSRV Academy shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any third-party websites or services.  

14. Governing Law and Dispute Resolution:

• These Terms and Conditions shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.  
• Any dispute arising out of or relating to these Terms and Conditions or the Services shall be subject to the exclusive jurisdiction of the courts located in Noida, Uttar Pradesh, India.  

15. Modifications to Terms and Conditions:

BIMSRV Academy reserves the right to modify or revise these Terms and Conditions at any time, with or without notice to you. The updated Terms and Conditions will be posted on our website. Your continued use of the Services after any such changes constitutes your acceptance of the revised Terms and Conditions. It is your responsibility to review these Terms and Conditions periodically for any updates or changes.  

16. Entire Agreement:

These Terms and Conditions, together with our Privacy Policy and any other legal notices published by BIMSRV Academy on the Services, constitute the entire agreement between you and BIMSRV Academy concerning the Services and supersede all prior and contemporaneous communications and proposals, whether oral or written, between you and BIMSRV Academy.  

17. Severability:

If any provision of these Terms and Conditions is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.  

18. Waiver:

No waiver of any provision of these Terms and Conditions shall be deemed a further or continuing waiver of such provision or any other provision, and BIMSRV Academy’s failure to assert any right or provision under these Terms and Conditions shall not constitute a waiver of such right or provision.
